Terms of Service

1. General considerations

The general terms and conditions of use of the online store bd-cosmetics.com are drawn up in accordance with the Consumer Protection Act (ZVPot), the Consumer Protection Against Unfair Commercial Practices Act (ZVPNPP), the Electronic Commerce on the Market Act (ZEPT), based on the recommendations of the Chamber of Commerce and Industry of Slovenia and international codes for e-commerce.

The online store is managed by BD COSMETICS d.o.o., Stara cesta 105, Logatec, 1370 Logatec (hereinafter referred to as the "provider"), registration number: 9158529000, the company is a VAT payer, VAT ID: SI44102062

The general terms and conditions deal with the operation of the webshop, user rights and the business relationship between the company and the customer.

The online store operates and concludes contracts in the Slovenian language with adults or persons over 15 years of age.

The online store has the right to change the terms of business by updating this publication. Such changes to the Terms are binding on the User.

The offer of goods published in the online store is valid until the cancellation of the offer is announced or until the sale of stocks.

The confirmation of the order informs the user of the general terms and conditions, the protection of personal data and the legal notice.

2. Availability of information

The provider undertakes to provide the buyer with the following information at all times: company identity, contact addresses, essential characteristics of goods or services, availability of products, conditions of delivery of the product or service, all prices clearly and unambiguously defined, method of payment and delivery, time validity of the offer, deadline within which it is still possible to withdraw from the contract and conditions for withdrawal and clarified procedure on complaint, including all information about the contact person or customer service.

3. Personal data protection

The provider undertakes to permanently protect all personal data of the buyer that he entered at the time of purchase (name, surname, address, postal code and mail, telephone, e-mail address), and we keep documentation of communication with him. The provider uses personal information about the buyer exclusively for the purpose of fulfilling the order (sending e-newsletters, offers, pro forma invoices, invoices, etc.) and other necessary communication. In no case does the provider hand over the buyer's data to unauthorized or third parties.

If the buyer (user) wishes to edit or delete their data from the provider's list, they can report this to the e-mail address: info@bd-cosmetics.com or send a written request via regular mail to the address: BD COSMETICS d.o.o., Stara cesta 105, Logatec, 1370 Logatec.

4. Payment methods

In the online store, the provider provides the following payment methods:

  • credit card payments via the Stripe system,
  • payment via PayPal and credit cards,
  • direct bank transfer.

The provider issues the customer a detailed bill with all expenses and instructions on how to withdraw from the purchase and return the products if necessary and possible. The purchase contract (order) is stored electronically on the provider's server.

We recommend that you print and save the general terms and conditions.

4.1. Payment via PayPal

The buyer pays directly through their PayPal account. After placing the order, it will be redirected to PayPal, where it confirms the value of the order. As soon as the buyer's PayPal account is debited, the buyer is redirected back to the store where the payment and order status is displayed. The PayPal account is charged for the actual amount of the account. If the payment via PayPal is not successful and the order is successfully placed, the buyer can contact the provider at info@bd-cosmetics.com and ask for assistance with payment or change the payment method.

5. Validity of the offer

Prices are subject to change without notice. When purchasing, prices are valid at the time of order confirmation.

6. Validity of the Special Offer

The validity periods of the offer are indicated at the time of the action offer itself, which may differ from each other.

7. Pricing

Prices of products in the online store are stated in euros (€) and already include VAT (value added tax), unless explicitly stated otherwise.

Product prices do not include shipping costs. These are indicated when calculating the value of the order before the electronic confirmation of the order.

All prices are valid at the time of placing the order and do not have a predetermined validity, so they are valid only until changes occur. BD COSMETICS d.o.o. reserves the right to change prices without prior notice.

The prices apply in the case of payment by the payment methods and under the conditions mentioned above. Despite the extraordinary effort to provide the most up-to-date and accurate data, it may be that the price information is incorrect. In this case, or in the event that the price of an item changes during the processing of the order, the provider will notify the buyer of the changes and allow the buyer to cancel the purchase, and at the same time offer the buyer a solution that provides mutual satisfaction. If the product is not in stock, there may be a price change, of which the provider informs the buyer.

8. Products and photos

Due to the nature of online business, the offer of products is updated and changed frequently and quickly. In order to present the basic characteristics of the sales products listed on the product packaging, the provider shall endeavour to provide clear and complete information. Products are constantly transformed (formulation update, packaging change) so that the content and ingredients of the product can be changed. The provider strives to keep the product information as accurate as possible and to keep it up-to-date. It may happen that certain mandatory information, list of ingredients, quantity, etc., may change from time to time. On the product received by the buyer, all mandatory information is indicated.

The provider recommends customers to always carefully read the information provided by the manufacturer of the product on the product packaging or label with the declaration before using the product. Product information is only available for personal use and may not be reproduced and used in any way without the prior consent of the provider. The provider reserves the right to make substantive and other changes to the online store without prior notice.

All photos are symbolic and do not guarantee the properties of the product. Colour shades and appearance of products may differ from the actual condition of the products, but this does not affect the definition and standard of the product. The provider accepts no responsibility for any minimal differences between the products and the display in the online store. Textual errors are possible and the provider assumes no liability for them, which does not affect the legal rights of the buyer.

9. Purchase process

The buyer chooses the type and quantity of the product, if available, additional properties (e.g. color). Before placing an order, review the shopping basket, make any corrections or proceed with the purchase. The following is an online form in which the buyer enters all the necessary information for the invoice and delivery of this product. After placing the order, changes are no longer possible. The buyer is sent a notice of the purchase by e-mail to the e-mail address indicated during the purchase.

9.1. Technical steps leading to the conclusion of the purchase contract

The following technical steps are available to the user (buyer) in the purchase process:

  • search for an individual product in the product offer in the online store,
  • selection of the product to be purchased,
  • adding the selected product to be purchased to the cart,
  • determining the quantity of the product to be purchased in the cart,
  • review of the price of the selected product in the selected quantity, including the tax charged,
  • invoice and delivery form,
  • selection of the method of delivery of the product,
  • selection of the method of payment,
  • review of the order with the selected method of delivery of the product and the calculated delivery costs, if these are charged,
  • confirmation and submission of the order and thus the completion of the purchase.

9.2. Technological means that enable the identification and correction of errors before placing an order

Before completing and placing an order, the buyer is allowed to:

  • see and inspect which products he has selected and added to the cart,
  • see and review the price of each product and the total price of the total selected quantity of each product,
  • the price and quantity of all selected products,
  • changes the quantity of selected products,
  • remove products from the cart,
  • verify and change the entered data,
  • changes the method of delivery/delivery,
  • changes the method of payment.

BD COSMETICS d.o.o., as the provider, sends the confirmation of receipt of the order to the e-mail address of the buyer indicated by him.

If the buyer does not want to place an order, they can leave the online store before placing the order.

9.3. Order accepted

After the submission of the order, the buyer receives an e-mail notice that the order has been received. During this step, the buyer has one hour to cancel the order, otherwise the order will be further processed.

If the buyer has chosen to pay by pro forma invoice as a payment method, he will receive a message on his e-mail address about the received order with the information for the transfer, a summary of the order and a confirmation of the concluded contract. 

9.4. Order confirmed

Order confirmed - if the customer does not cancel the order in due time, the order is further processed; the provider reviews the order, checks the availability of ordered products and confirms or rejects the order (and providing the reason for the rejection). The provider reserves the right to contact the buyer via the provided phone number to verify the provided information or request additional information in order to complete the order.

In the case of delivery of goods that the provider does not have in stock in its own warehouse, the provider is exclusively bound to the delivery by the provider's supplier and to the time during which the supplier can deliver the goods to the provider. By e-mail, the provider informs the buyer of up-to-date information regarding the delivery of goods.

If the delivery period is very long and the buyer does not want to wait, the buyer can inform the provider who will remove the item from the order and return to the buyer any funds already paid, and other items from the order at the buyer's choice, either delivered, or cancel the entire order.

The Provider assumes no liability for damage resulting from longer delivery times or from non-delivery of goods that the Provider does not have in stock in its own warehouse.

9.5. Goods dispatched

The bidder prepares the goods within the agreed deadline, dispatches them and informs the buyer thereof by e-mail.

10. Delivery

For the delivery of all orders placed in the online store, we perform via DPD and DHL Express delivery service:

  • DPD d.o.o., Brnčičeva ulica 31, SI-1231 Ljubljana - Črnuče (hereinafter: DPD), VAT ID: SI46749845, registration number: 1966812000,
  • DHL Express (Slovenia), d.o.o., Špruha 19, Trzin, 1236 Trzin (hereinafter: DHL), VAT ID: SI18805477, registration number: 5385504000.

Goods ordered in the online store will be delivered by the provider to the address indicated during shopping in the online store within three working days. If, due to special circumstances, this is not possible, the provider will inform the buyer of this via the e-mail address specified by the buyer while filling out the online form in the online store and try to reach an appropriate agreement with him. DPD and DHL deliveries are made in accordance with their own business policy.

The goods are delivered by the provider to the address indicated by the buyer when filling out the online form in the online store. In the case of a personal pick-up, the provider agrees on the exact time and place of the pick-up with the buyer by establishing a contact via the e-mail address or telephone number of the buyer, which he indicated while filling out the online form in the online store.

11. Right of withdrawal, return of goods, return of payment

The buyer has the right to inform the provider within 3 days of receipt of the goods at the e-mail address info@bd-cosmetics.com or in writing to the address BD COSMETICS d.o.o., Stara cesta 105, Logatec, 1370 Logatec, that he withdraws from the contract or order without having to state the reason for his decision, by covering the direct costs of the return.

The buyer who withdraws from the purchase in writing may make a statement of withdrawal from the purchase on the Form for exercising the consumer's right of withdrawal, which is Annex 1 to these General Terms and Conditions.

If the buyer has already received the goods and withdraws from the contract, he must send the goods undamaged and in unchanged quantity to the provider within 14 days after the notification that he is withdrawing from the contract. The only cost related to the withdrawal from the contract that the buyer is liable to pay is the cost of returning the goods.

The received goods must be returned undamaged by the buyer and in the unchanged form and in the unchanged quantity, unless the goods are damaged without the fault of the buyer.

The buyer can tell the provider how to return the paid purchase price and possible shipping costs. Failure to do so will result in the provider being refunded the purchase price and any shipping costs in the same way as they were charged.

Within 14 days from the date on which the buyer informed the provider of the withdrawal from the purchase, the provider shall refund the purchase price by bank transfer to the buyer's bank account, but only if the provider has actually received the payment.

12. Warranty

The products in the online store are subject to warranty conditions in accordance with Slovenian law.

13. Material defects

The buyer may exercise his rights arising from a material defect if he notifies the company of the defect within two months from the date on which the defect was discovered. In the notification of a defect the consumer shall precisely describe the defect and enable the provider to inspect the product.

The seller shall not be liable for material defects that appear more than two years after the item was delivered. When a defect appears within six months of the item being delivered, the defect shall be deemed to have existed at the time of delivery.

The buyer who has correctly notified the seller of the damage and the seller acknowledges the damage, has the right to request the seller to fix the damage on the goods or return part of the amount paid in proportion to the damage or replace the defective goods with new faultless goods or return the amount paid.

14. Complaints and out-of-court settlement of consumer disputes

The provider does not recognize any out-of-court consumer dispute resolution provider as competent to resolve a consumer dispute that the buyer could initiate in accordance with the Out-of-Court Consumer Dispute Resolution Act (ZIsRPS).

The buyer can submit the complaint to the provider in writing at the e-mail address info@bd-cosmetics.com or the address BD COSMETICS d.o.o., Stara cesta 105, Logatec, 1370 Logatec.

15. Preservation of the contract and contractual language

The contract will be concluded in the English language. The provider stores the text of the contract and the order data, but these are not available to the buyer online. The order summary, sent to the buyer's e-mail address, contains all the essential information about the order and the remaining text of the contract, which the buyer can also print out.

16. Newsletter

By subscribing to the e-newsletter, the user agrees that the personal data provided when subscribing to the e-newsletter are used or processed to forward messages related to the business of the provider (campaigns, novelties, advertising messages, newsletters, etc.) to his e-mail address.

Such consent shall be revoked by the user in writing at any time. You can cancel by clicking on the "unsubscribe" link in the email you received. The cancellation can also be forwarded to the e-mail address info@bd-cosmetics.com or to the address BD COSMETICS d.o.o., Stara cesta 105, Logatec, 1370 Logatec.
